These terms apply when you use nexera-in.co.za or buy or use a NEXERA-IN product. By using the site or buying, you agree to them.
1. Who we are
The site is operated by Nexera-In (Pty) Ltd (registration number REG_NO), South Africa (“NEXERA-IN”, “we”, “us”). Contact: [email protected].
2. Products and licence
- Our products are software and digital files. When you buy, you get a personal, non-transferable licence to use the product for your own work or your business, according to the plan you bought.
- You may not resell, share your account, copy for distribution, or reverse-engineer the products.
- We keep ownership of the software, content, names and logos.
3. Free tools
Free tools (such as the Construction CalculatorIQ web app) are provided “as is”. We work hard to make them accurate, but results are a guide and must be checked by a competent person before you order materials, build, or rely on them for design or safety decisions. Scaffold and structural work must always comply with the applicable SANS standards and the Construction Regulations, and be signed off by the appropriate competent person.
4. Prices and payment
- Prices are in South African rand (ZAR). Where VAT applies it is shown on the receipt.
- Payment is processed by PayFast. We do not see or store your card details.
- Your order is only confirmed once PayFast confirms the payment to us.
5. Subscriptions
- Subscriptions are billed monthly in advance through PayFast until you cancel.
- You can cancel at any time in My Account or by emailing us. Cancelling stops future payments; access continues until the end of the period already paid for. There are no partial refunds for part-months.
- We will give you at least 30 days’ notice by email before changing a subscription price.
6. Delivery and refunds
See our Delivery Policy and Refund Policy. Your rights under the Consumer Protection Act and the Electronic Communications and Transactions Act (ECTA) are not limited by these terms where those Acts apply.
7. Your account
You are responsible for keeping access to your email account secure, because that is how you log in. Tell us immediately if you think someone else has accessed your account.
8. Acceptable use
Do not use the site or products to break the law, to attack or overload our systems, or to infringe anyone’s rights.
9. Limitation of liability
To the extent allowed by law, NEXERA-IN is not liable for indirect or consequential loss (such as lost profit, delays or penalties on a contract) arising from use of the products. Our total liability for any claim is limited to the amount you paid us for the product in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Changes and availability
We may update products, these terms and the site. We will publish the new terms here with a new date. We aim for the site to be available at all times but do not guarantee it.
11. Law
These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction.
